Privacy Policy

This Privacy Policy explains how Noiseyard Yazılım Ltd. (“Noiseyard,” “we,” “our”) collects, uses, and protects personal data when you use our website (noiseyard.com) or any website created using the Noiseyard platform (“Hosted Websites”).

By accessing our Website or using our Services, you agree to the terms of this Privacy Policy. If you do not agree, please do not use our Services.

Definitions and Key Terms

For clarity, these terms are used consistently throughout this Privacy Policy:

  • Company: Noiseyard Yazılım Ltd. (Hasanpaşa Mah. Nabizade Sk. No:82 / 1, 34722 Kadıköy/İstanbul), the entity responsible for processing your personal data under this policy.

  • Website, Platform: Refers to Noiseyard’s site and its associated domains (including noiseyard.com) and the services made available through them.

  • Services: The Noiseyard platform and all features it includes, such as hosted websites, mailing list tools, and analytics.

  • Hosted Website / User Website: Any website created and managed by a Noiseyard user through our platform, including public pages, media, and content under a custom or Noiseyard-provided domain.

  • Customer / User / You: The individual or entity who registers for and uses Noiseyard’s Services to create a Hosted Website or manage communications with their own site visitors.

  • End User, End Customer, Buyer: A visitor or customer who interacts with a Hosted Website (e.g., signs up for a mailing list, places an order) but does not have a Noiseyard account.

  • Device: Any internet-connected device (e.g., phone, tablet, computer) used to access Noiseyard or a Hosted Website.

  • IP Address: A numerical label assigned to each device connected to the Internet, used for location estimation and diagnostic purposes.

  • Personnel: Noiseyard employees or contractors working on our behalf.

  • Personal Data: Any information that identifies or could reasonably be used to identify a natural person, including names, email addresses, and account information.

  • Third-Party Service: External platforms or providers that may be integrated with Noiseyard or a Hosted Website (e.g., Meta Pixel, Stripe, embedded forms or widgets).

  • Cookie: A small text file stored by your browser that helps websites remember your preferences, login details, or activity.

  • Payment Processor: A third-party payment provider used by a Hosted Website owner to accept payments from Buyers (e.g., Stripe).

  • Fulfillment Partner: A third-party provider that manufactures, fulfills, ships, or delivers physical products on behalf of a Hosted Website owner (e.g., Printful).

  • Printful Products: Physical products displayed on a Hosted Website via the Printful integration and fulfilled by Printful.

  • Order Data: Information related to a purchase on a Hosted Website, such as items purchased, shipping address, contact information, and fulfillment status.

Hosted Websites are created and managed by Noiseyard Users. When you interact with a Hosted Website, the Hosted Website owner determines what they collect and how they use it (for example, mailing lists and store policies). Noiseyard provides the technical platform and processes certain data on the owner’s behalf to operate the Hosted Website.


What Information Do We Collect?

We collect different categories of information depending on whether you are (i) a Noiseyard customer with an account (“Customer/User”), or (ii) an End User visiting a Hosted Website (for example, subscribing to a mailing list or placing an order).

A) If you are a Noiseyard Customer/User (account holder):

  • Name/artist, band or project name

  • Email address

  • Login credentials (such as password)

  • Subscription/billing details (handled by our billing providers; we do not store full payment card details)

B) If you are an End User interacting with a Hosted Website:

  • Email address and name (e.g., mailing list signups, contact forms)

  • Order-related information (e.g., items purchased, shipping address, and contact details needed to fulfill an order)

  • Technical data (e.g., IP address, device/browser info)


Use of End User Information from Third Parties

We do not currently obtain End User personal data from third-party sources for enrichment purposes. If this changes in the future, we will update this Privacy Policy and describe the sources and purposes.


Use of Customer Information from Third Parties

We may receive information from third parties when you contact us. For instance, submitting your email may provide us with details from fraud detection services. We may also collect publicly available information from social media. You can manage the visibility of your information through your privacy settings.


Do We Share the Information We Collect with Third Parties?

We do not sell or rent your personal information to anyone. We only share personal and non-personal information with trusted third parties as necessary to operate, improve, and support our Services. For example: hosting providers, billing providers (for subscriptions), analytics tools, and email service providers.

If a User enables a Fulfillment Partner integration (such as Printful) and an End User places an order for Printful Products, we may share Order Data (including customer contact and shipping information) with the Fulfillment Partner solely to manufacture, fulfill, and ship the order. Fulfillment Partners process this information under their own terms and policies. In these cases, the Hosted Website owner (the User) is responsible for the store relationship with the End User, and Noiseyard may process and transmit Order Data as a service provider to operate the Hosted Website and enable fulfillment.

If we undergo a merger, acquisition, or sale of assets, your information may be transferred to the successor entity, provided they agree to adhere to this Privacy Policy. We may also share information if required by law, to protect our rights, or to prevent illegal activities.


Where and When Is Information Collected from Customers and End Users?

We collect data when you:

  • Register or log into your account

  • Submit forms, make purchases, or join a mailing list

  • Interact with a Hosted Website

  • Contact our support team


How Do We Use the Information We Collect?

We use your information to:

  • Provide and improve our Services

  • Operate and maintain Hosted Websites

  • Support subscription billing and Service operations (e.g., account administration, invoices, security)

  • Facilitate Hosted Website interactions (e.g., mailing list signups, order-related notifications, and, where enabled, transmitting order details to fulfillment partners for delivery)

  • Send marketing, service-related, or transactional emails

  • Monitor platform performance and security


Payment Details

Noiseyard uses third-party billing providers for subscription transactions. We do not store or process your payment information. All billing is securely handled by Lemon Squeezy and is subject to their privacy policy.

For purchases made on a Hosted Website, payments are processed by the Hosted Website owner’s Payment Processor (for example, Stripe). Noiseyard does not store or process End Users’ payment card details for these purchases.


How Do We Use Your Email Address?

By submitting your email, you agree to receive communications from Noiseyard or from the creator of the Hosted Website you interacted with. These may include:

  • Transactional emails (e.g., account setup and service emails from Noiseyard; and for Hosted Websites, order-related emails are sent by the Hosted Website owner or their configured providers)

  • Platform updates or reminders

  • Mailing list messages from the creator

You can unsubscribe anytime using the opt-out link in the email.


How Long Do We Keep Your Information?

We retain your information only as long as necessary to fulfill the purposes outlined in this policy or as required by law.

  • Voluntary Cancellation: If you cancel your subscription, your account data and all associated content (including any Hosted Website data) will be permanently deleted at the end of your current billing or trial period.

  • Payment Failures: If your payment fails, your account will follow the process in our Terms of Use:

    • Past Due (14 days) → No deletion; payment retried automatically.

    • Unpaid (up to 90 days) → Website taken offline; data retained so you can resume service by updating payment details.

    • Expired (after 90 days in Unpaid) → Permanent deletion of all account data and associated content.

Once deleted, data cannot be recovered unless we are legally or operationally required to retain it.


How Do We Protect Your Information?

We use technical and organizational safeguards, including SSL encryption and access controls. While no system is 100% secure, we strive to protect your data with industry-standard methods.


International Transfers

By using our Services, you understand that your information may be processed in Türkiye and in other countries where we or our service providers operate. This may include hosting, analytics, billing providers, and, if enabled by a Hosted Website owner, fulfillment partners such as Printful. Some providers may process data in the United States and other jurisdictions depending on their infrastructure.

Updating or Deleting Your Information

You may contact us at support@noiseyard.com to:

  1. Update or correct your account information

  2. Change your communication preferences

  3. Request deletion of your personal data (where applicable)

End Users should contact the owner of the relevant Hosted Website to update or remove their information. This includes requests related to store orders and fulfillment, because the Hosted Website owner controls the storefront relationship and policies. Noiseyard may assist Hosted Website owners by applying deletion requests where technically possible, but End Users should initiate requests with the Hosted Website owner.


Personnel Information

If you are a Noiseyard worker or applicant, we collect information you voluntarily provide for Human Resources purposes, including benefits administration and applicant screening.

You may contact us to (1) update or correct your information, (2) change your communication preferences, or (3) request a record of the information we hold about you. Such updates will not affect information maintained prior to your request.


Affiliates

We may disclose your information to our Corporate Affiliates, defined as entities that control, are controlled by, or are under common control with Noiseyard. Any information shared will be treated according to this Privacy Policy.


Governing Law

This Privacy Policy is governed by the laws of Türkiye. Any disputes relating to this Privacy Policy will be handled in accordance with the dispute resolution provisions in our Terms of Use.

By using Noiseyard or contacting us, you accept this Privacy Policy. If you do not agree, please refrain from using our services. Continued use signifies acceptance of any changes we may make.


Your Consent

By visiting our website, using our services, registering, or making a purchase, you consent to this Privacy Policy and its terms.


Links to Other Websites

This Privacy Policy applies only to Noiseyard's services. We are not responsible for third-party websites linked to our platform. Their policies apply once you leave our site.


Cookies and Tracking Technologies

We use cookies and similar technologies to improve performance and user experience. You can block or disable cookies in your browser, though some features may not work as intended.

If Meta Pixel is enabled on a Hosted Website, Noiseyard will automatically display a cookie consent banner to visitors. Noiseyard does not store or process data collected by Meta.

Other Third-Party Integrations (such as analytics tools, widgets, embeds, or event integrations) may set cookies or collect data according to their own policies. Hosted Website owners are responsible for enabling and configuring these tools and for providing any notices/consents required by law.


Changes to Our Privacy Policy

We may update this Privacy Policy to reflect changes in our services. We will notify you via email of significant changes and provide an opportunity to review them. By continuing to use our services, you agree to any changes to this policy.


Third-Party Services

We may provide links to third-party services. Noiseyard is not responsible for their content or practices. Use of these services is at your own risk.

Hosted Website Responsibility

If you create a website using Noiseyard, we provide default tools, such as a privacy policy template and, if Meta Pixel is enabled, a cookie consent banner, to help you meet common legal requirements.

However, you are responsible for ensuring your Hosted Website complies with applicable laws (including GDPR, CCPA, and other privacy regulations) regarding the collection, storage, and processing of visitor data.

Please note: if your Noiseyard account is deleted (due to cancellation or non-payment), all Hosted Website data will be permanently deleted in accordance with the How Long Do We Keep Your Information? section above.

Affiliate Program Data

If you participate in the Noiseyard Affiliate Program, we may collect data such as referral links, cookie-based tracking activity (valid for 14 days), and commission records. This data is used solely to track referrals and process affiliate payouts. All commission tracking and payments are managed by Lemon Squeezy, and your participation is subject to their privacy practices and payout terms.
